2. The Domain Name and Registrar

The disputed domain name <viagra.com> is registered with WebMD, Inc., of New York, United States of America.

3. Procedural History

The Complaint was filed with the WIPO Arbitration and Mediation Center (the “Center”) on October 14, 2005. On October 14, 2005, the Center transmitted by email to WebMD a request for registrar verification in connection with the domain name at issue. On October 15, 2005, WebMD transmitted by email to the Center its verification response confirming that the Respondent is listed as the registrant and providing the contact details for the administrative and billing correspondence. The Center verified that the Complaint satisfied the formal requirements of the Uniform Domain Name Dispute Resolution Policy (the “Policy”), the Rules for Uniform Domain Name Dispute Resolution Policy (the “Rules”), and the WIPO Supplemental Rules for Uniform Domain Name Dispute Resolution Policy (the “Supplemental Rules”).

In accordance with the Rules, paragraphs 2(a) and 4(a), the Center formally notified the Respondent of the Complaint, and the proceedings commenced on October 16, 2005. In accordance with the Rules, paragraph 5(a), the due date for Response was December 3, 2005. The Respondent did not submit any response. Accordingly, the Center notified the Respondent’s default on December 5, 2005.

The Center appointed Karen L. Lachowsky as the sole panelist in this matter on December 18, 2005. The Panel finds that it was properly constituted. The Complainant has a valid and enforceable trademark registration. The mark “viagra” is registered to “viagra”.

The Complainant’s registration and registration with the Internet is not enforceable.

The Respondent registered the disputed domain name on October 15, 2005. At the time of the Respondent’s registration, the Respondent had no rights or legitimate interest in the disputed domain name.

The disputed domain name includes the disputed domain name as well as other domain names that have been registered and registered at a time other than the one at issue. The Respondent registered the domain name on October 15, 2005.

The disputed domain name and other domain names are the result of an Internet marketing campaign that commenced in August 2001.
